Each IP Update willl address hot topics and recent case law regarding intellectual property law, including federal and California law and, where appropriate, trends in the laws of other States.

R.E.A.C.H. (Real Estate and Construction Highlights)


Real Estate And Construction Highlights is a quarterly newsletter published for real estate and construction professionals, including attorneys, brokers, agents, lenders, title specialists and contractors. Each new issue of REACH will discuss recent developments in California legislation or appellate court decisions of importance in real estate or construction.

Recent Publications

The California Supreme Court upheld a mandatory arbitration provision between a homeowners’ association and a property developer. Two lower courts (as well as a dissenting Justice) found that the association had not waived its constitutional right to a jury trial because the property developer negotiated that arbitration provision with itself before the association even existed. But the Supreme Court reversed, finding the arbitration provision enforceable in Pinnacle Museum Tower Ass’n v. Pinnacle Market Development. Ken Van Vleck comments on this case of first impression in the December 13, 2012 American Bar Association Section of Litigation’s Real Estate Litigation. “Homeowners’ Association Case May Signal Change in Unconscionability Analysis”

Wage-and-Hour Challenges in Drug Sales” by Elizabeth Roth and Robert W. Luckinbill appeared in August 2011 in The Recorder, a leading online and print publication on cutting edge legal issues affecting California. This article was also published under the title “Courts Split on Overtime for Pharmaceutical Reps” on August 25, 2011 in the Daily Business Review, a publication in the national Law.com network of ALM Media Properties. This article follows up on their previous publication, “Love and Other Drugs in Real Life,” and analyzes recent and contentious developments in litigation relating to the appropriate employment classification of pharmaceutical sales representatives.

"'Love and Other Drugs' in Real Life" by Elizabeth Roth and Robert W. Luckinbill appeared in April 2011 in seven sections of the Law360 online legal news site as well as seven newsletters distributed by Law360. The article relates to conflicting decisions reached by various circuit courts concerning the appropriate employment classification of pharmaceutical sales representatives. This is one of many employment areas handled by the attorneys in the Firm's Employment Law Group, of which Ms. Roth and Mr. Luckinbill are members.

"Landslide Liability Issues" by Kenneth R. Van Vleck appeared in the 2011 Winter edition of the ABA Real Estate Litigation Newsletter. The Firm handles a variety of construction defect, landslide, and real property litigation matters. Mr. Van Vleck is a partner in the Firm's Real Estate and Litigation departments.

"Season's Greetings and Legal Challenges" by Elizabeth Roth and Barbara Tanzillo appeared in the 2010 Insights series of the Daily Journal on November 24, 2010. The Firm handles a variety of employment law matters. Ms. Roth and Ms. Tanzillo are partners in GCA's Employment Law Group.

Litigation partner Jeffrey Lee represents clients in intellectual property matters, including patent, copyright, trademark and trade secret disputes and litigation. He co-authored with computer scientist Dr. Graham Morgan, "Controversy in Video Game Invention: The Infallible Pioneer Patents" in COMPUTING SCIENCE, published by the University of Newcastle upon Tyne, England, United Kingdom, in October 2009.

"The Complications of Overtime Exemption Laws in a Service Economy" by Elizabeth Roth and Barbara Tanzillo appeared in the Daily Journal on January 26, 2010. The Firm handles numerous wage and hour issues for its clients, and Ms. Roth and Ms. Tanzillo previously addressed the Silicon Valley Association of General Counsel on the topic "Classifying Employees in the High-Tech World."

"Sotomayor and Roger Traynor: The Job Interviews" by Elizabeth Roth was published September 24, 2009 in national legal newsletters Employment Law360 and Appellate Law360, which are publications of Law360: The Newswire for Business Lawyers. This article was also published in The Judges' Journal, Winter 2010, Vol. 49, No. 1, a publication of the Judicial Division of the American Bar Association.
